Evidence that the accused was driving on a public street suffices 20 to show that the accused was in a "public place".
[2] Tort - Negligence - Res ipsa loquitur - Accident Unexplained does not in itself make doctrine applicable.
The fact that automobile accident is unexplained does not bring the res ipsa loquitur doctrine into effect to show that the driver was at 25 fault, at least so long as reasons for the accident consistent with the driver's innocence can be advanced.
